Welcome to Da Buoys! These Terms of Service ("Terms") govern your use of the Da Buoys iOS application ("the App") provided by Brevify ("we", "our", "us"). By using Da Buoys, you agree to these Terms. If you don't agree, please don't use the App (but we'll miss you in the lineup).

What Da Buoys Does

Da Buoys provides real-time ocean buoy data from various sources including NOAA and PacIOOS. We display this information in a clean, easy-to-read format to help you make informed decisions about ocean conditions.

Your Use of Da Buoys

You may use Da Buoys for:

  • Checking real-time ocean conditions
  • Planning your surf sessions, boat trips, or beach days
  • Impressing your friends with your knowledge of wave periods
  • Making excuses for why you're late to work (again)

You may NOT use Da Buoys for:

  • Any illegal purposes
  • Making critical safety decisions without consulting official sources
  • Claiming you invented the app (we did that)
  • Blaming us when the waves don't match your expectations

The Data We Show

All ocean data displayed in Da Buoys comes from third-party sources (NOAA, PacIOOS, etc.). While we strive to present this data accurately and in real-time:

  • We don't create or control this data
  • Buoys can malfunction, drift, or report incorrect data
  • Network issues might cause delays or missing data
  • The ocean doesn't care about your plans

Disclaimers (The Legal Stuff)

Da Buoys is provided "as is" without any warranties, express or implied. We make no guarantees about:

  • The accuracy, reliability, or completeness of buoy data
  • The app's availability or uninterrupted operation
  • Whether the waves will be good when you paddle out
  • Your ability to actually surf the waves shown in the data

Limitation of Liability

To the maximum extent permitted by law, Brevify and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Missing the best swell of the year
  • Paddling out when it's flat
  • Getting worked by waves bigger than expected
  • Any decisions you make based on buoy data

Ocean Safety

IMPORTANT: Ocean conditions can be dangerous. Da Buoys is an informational tool only. Always:

  • Check multiple sources before entering the water
  • Respect your limits and local conditions
  • Follow local safety guidelines and warnings
  • Remember: if in doubt, don't go out

Intellectual Property

The Da Buoys app, including its design, features, and content (excluding third-party data), is owned by Brevify. You may not copy, modify, or distribute the app without our permission. The ocean, however, belongs to everyone.

Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we'll notify you through the app. Your continued use after changes means you accept the new Terms.

Governing Law

These Terms are governed by the laws of Hawaii (where else?), without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hawaii, preferably over a post-surf smoothie.
